Article Icon 1Federal Judge Bars Fencing Off Forest

A federal judge ruled that a southwest Colorado group that fenced off more than 1,400 acres of the San Juan National Forest in 2024 has no legal claim to the land.

Chief U.S. District Judge Daniel Domenico granted summary judgment to the U.S. on Sept. 30, barring the Free Land Holder Committee from fencing the land near Mancos.

The group’s argument centered on whether “the” was capitalized in historical references to the United States. Its two representatives asked Domenico to amend his ruling last week.

Representative Patrick Pipkin said the committee does not accept the order but does not plan to erect another fence. Local residents tore down the original fence in 2024.

Denver’s highs stayed in the 80s through the weekend, an unusual streak for October. Monday should be mostly quiet and warm again, with temperatures near 80.

Cooler air arrives Monday night, dropping Tuesday’s highs by about 10 degrees to near-average. Rain chances begin late Tuesday, and Wednesday highs may struggle to reach the 60s.

In southern Colorado, the Pikes Peak region stays near 80 Monday before showers move in Tuesday. Highs fall to the low 60s by Wednesday and Thursday.

Higher mountain elevations could see several inches of snow through Thursday, with snow levels near 10,000 feet in what looks like the season’s best storm so far.
