Article Icon 1Judge Rules ICE No-Bond Policy Illegal

A federal judge in Denver has ruled that a new Immigration and Customs Enforcement policy of denying bond hearings to illegal immigrants violates federal law.

The ruling is the latest development in a lawsuit filed on behalf of Nestor Gutierrez, an illegal immigrant who’d been held in Aurora’s detention center since May.

Gutierrez’s attorneys argued he doesn’t meet the criteria for limited bond eligibility, citing his decades-long residency in Colorado and alleging that the broadened no-bond policy implemented July 8 is unlawful.

The judge ordered Gutierrez’s release pending a bond hearing. His attorneys are still working with the American Civil Liberties Union to certify the case as a class-action lawsuit.

Article Icon 1No Charges Filed in Firefighter Prank

Prosecutors have decided not to file charges against two Aurora firefighters who ran a police sergeant off the road in a Feb. 25 incident the pair described as a “prank.”

Footage shows an Aurora fire engine with high beams and spotlights activated, speeding in the wrong lane toward Sgt. Tony Spano’s police car, forcing it off the road. See the video here.

The firefighters claimed they were “messing around” and had mistaken Spano for someone they knew. Spano, who believed they’d “tried to kill” him, pushed for criminal charges.

Based on the evidence, an assistant district attorney found the firefighters’ actions were “childish and foolish” but “not criminal.” Both were demoted over the incident.
